1. Service Description

Fair-QR is a free web-based QR code generator provided by Wapps GmbH. The service allows you to:

• Generate QR codes for various data types (URLs, text, WiFi, vCards, etc.)
• Customize QR code appearance (colors, size, error correction)
• Embed logos in QR codes
• Download QR codes in multiple formats (PNG, JPEG, SVG)
• Store QR code history locally in your browser

Important: All QR code generation happens entirely in your browser. We do not process or store your QR code content on our servers.

2. Free Service - No Warranty

Fair-QR is provided free of charge and "as is" without any warranties, express or implied. This includes but is not limited to:

• No guarantee of uninterrupted availability or uptime
• No guarantee that generated QR codes will be scannable in all conditions
• No warranty of fitness for a particular purpose
• No guarantee of compatibility with all QR code scanners
• No guarantee of accuracy or correctness of generated QR code content
• No warranty that QR codes will function as expected in all environments

You use Fair-QR entirely at your own risk. You are solely responsible for:

• Testing and verifying all generated QR codes before use or distribution
• Ensuring QR codes contain the correct content and work as intended
• Any consequences resulting from the use of QR codes generated with this service
• Compliance with all applicable laws and regulations when using QR codes

We reserve the right to modify, suspend, or discontinue the service at any time without prior notice or liability.

3. User Responsibilities

When using Fair-QR, you agree to:

• Use the service legally: Do not encode illegal, harmful, or malicious content in QR codes
• Respect intellectual property: Only upload logos and content you have the right to use
• Test QR codes: Verify that your generated QR codes work correctly before distribution
• Use at your own risk: We are not liable for any damages resulting from your use of the service

4. Prohibited Uses

You may not use Fair-QR to:

• Encode illegal content, malware, phishing links, or harmful URLs
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Distribute spam or unsolicited commercial content
• Attempt to reverse-engineer, hack, or compromise the service
• Use the service for automated scraping or mass generation (excessive load)

5. Intellectual Property

Your Content: You retain all rights to the content you encode in QR codes and any logos you upload. We do not claim ownership of your content.

Our Service: Fair-QR, including its design, code, and branding, is the intellectual property of Wapps GmbH. You may not copy, modify, or redistribute our service without permission.

Generated QR Codes: QR codes you generate are yours to use freely. However, you are responsible for ensuring your use complies with QR code standards and any applicable third-party rights.

6. Logo Uploads

When you upload a logo to embed in a QR code:

• The logo is processed entirely in your browser (not uploaded to our servers)
• You must have the legal right to use the logo
• Logos should not contain offensive, illegal, or copyrighted content you don't own
• Maximum file size: 2MB
• Supported formats: PNG, JPEG, SVG

7. Limitation of Liability

IMPORTANT: You acknowledge and agree that Wapps GmbH has NO LIABILITY for the content, accuracy, functionality, or consequences of QR codes generated using Fair-QR.

To the maximum extent permitted by law, Wapps GmbH and its affiliates shall not be liable for:

• QR Code Issues: QR codes that fail to scan, contain errors, display incorrect content, or malfunction in any way
• Content Liability: Any content encoded in QR codes, including illegal, harmful, misleading, or inaccurate information
• Business Damages: Loss of profits, revenue, business opportunities, customers, or reputation
• Data Loss: Loss or corruption of data, including QR code history stored locally
• Consequential Damages: Any indirect, incidental, special, punitive, or consequential damages
• Service Issues: Damages resulting from use, inability to use, or interruption of the service
• Third-Party Claims: Claims arising from your use or distribution of generated QR codes
• Security Issues: Unauthorized access, hacking, or security breaches related to your use of the service

Maximum Liability Cap: In any event, our total aggregate liability shall not exceed EUR 100, regardless of the number of claims or theory of liability.

Legal Disclaimer: This limitation of liability applies to the fullest extent permitted by Austrian law. Mandatory statutory liability (e.g., for intentional misconduct, gross negligence, personal injury, or death) remains unaffected. Nothing in these terms excludes liability that cannot be legally excluded.

Important: You have no legal claim, warranty, or guarantee regarding the functionality, accuracy, or fitness of Fair-QR or any QR codes generated. By using this service, you accept full responsibility for all consequences.

8. Data & Privacy

Fair-QR is designed with privacy in mind. Please refer to our Privacy Policy for details on how we handle data.

Key points:

• QR codes are generated client-side in your browser
• We do not store your QR code content on our servers
• Browser history is stored locally using LocalStorage (optional, can be cleared)

9. Third-Party Services

Fair-QR is hosted on Vercel Inc. (USA). By using Fair-QR, you acknowledge that technical hosting data may be processed by Vercel as described in our Privacy Policy.

External links (e.g., to our company website) are provided for convenience. We are not responsible for the content or practices of third-party websites.

10. Changes to Terms

We may update these Terms of Service from time to time. Significant changes will be indicated by updating the "Last updated" date below. Continued use of the service after changes constitutes acceptance of the new terms.

11. Governing Law

These Terms of Service are governed by the laws of Austria, excluding its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts in Steyr, Austria.
