Terms of Service
By using Fair-QR, you agree to these terms. They apply to both the public Offline generator and the Smart QR dashboard with account and payment features.
1. Service Description
Fair-QR is provided by Wapps GmbH and includes two separate product areas:
- Offline QR (public): client-side QR creation in the browser without mandatory account
- Smart QR (dashboard): managed QR codes with editable targets, routing, landing pages, and analytics
- User accounts with authentication for SaaS functionality
- Logo uploads, QR design features, and download/rendering functionality
- Paid plans and/or one-time purchases via Stripe
Important: The Offline generator is designed for local usage. Smart QR features process data server-side so management, updates, and analytics can work.
2. Availability, Scope & Warranty
We provide Fair-QR with commercially reasonable efforts and continuously improve the service. However, limitations can occur:
- No guarantee of uninterrupted availability or error-free operation
- No committed service level agreement (SLA) unless explicitly agreed in writing
- No guarantee that generated QR codes are scannable in all environments
- No guarantee that routing decisions, redirects, landing delivery, or tracking/analytics capture are always complete, accurate, or delay-free
- No guarantee that third-party integrations remain unchanged or continuously available
- No promise of specific business outcomes (for example conversion or scan volume)
- Technical changes, maintenance windows, and security controls may temporarily affect features
- Fair-QR is not designed for high-risk use cases where malfunction could cause personal injury, health/safety incidents, or major property damage
You are responsible for productive use of your QR codes, including:
- Testing and validating before print, publication, or mass distribution
- Performing regular functional checks of production Smart QR targets and routing rules
- Configuring appropriate fallback destinations when target systems or providers are temporarily unavailable
- Ensuring legality and accuracy of linked content
- Keeping credentials and API keys secure
- Using automation for Smart QR processing only through provided and authorized API interfaces
- Complying with all applicable laws and industry requirements
We may change, extend, or discontinue the service for technical, security, legal, or business reasons, unless mandatory legal rights require otherwise. Where reasonably possible, we will provide advance notice of material planned changes. If these terms are violated, we may apply proportionate protective measures, including feature restrictions, suspensions, and API key revocation.
3. User Responsibilities
When using Fair-QR, you agree to:
- Use lawfully: Do not use Fair-QR for illegal, harmful, fraudulent, or abusive content (including phishing and malware).
- Respect rights: Upload only content and logos for which you have all required rights.
- Exercise due care: Verify configuration, destination URLs, landing pages, and redirects before use.
- Protect account security: Protect your account, passwords, and access tokens, and notify us immediately if you suspect misuse, bot activity, or compromised credentials.
4. Prohibited Use
You must not use Fair-QR to:
- Distribute illegal content, malware, fraud, or phishing
- Violate third-party rights (including IP, trademark, or privacy rights)
- Bypass, probe, or attack security mechanisms
- Run unauthorized high-volume automation
- Use bots, crawlers, scrapers, or headless clients for account creation, login, dashboard interaction, or data extraction unless expressly allowed through the provided API
- Perform automated processing outside the offered API or circumvent API/security limits
- Bypass or interfere with CAPTCHA, rate limits, abuse protections, or access controls
- Share, sell, or transfer API keys, access tokens, or account access without authorization
- Perform security scanning, penetration testing, or load testing without our prior written approval
- Disrupt the service through abuse or overload
- Manipulate payment, subscription, or billing workflows
- Repeatedly or materially violate these rules; in such cases we may suspend accounts, revoke API keys, and terminate service access without notice where legally permitted
5. Intellectual Property
Your content: You retain rights to your content, including QR destinations, landing content, and uploaded logos. You grant us only the rights required to technically provide the service.
Our service: Fair-QR (including software, design, brands, and documentation) is intellectual property of Wapps GmbH or its licensors and is protected by law.
Generated QR codes: You may use your generated QR codes subject to applicable laws. You remain responsible for lawful and correct use.
6. Logo Uploads
If you use logos in Smart QR, the following applies:
- Uploads may be stored server-side in a dedicated storage bucket
- A public object URL may be used for rendering and delivery
- You must only upload files for which you hold all required rights
- Illegal, infringing, or harmful material is prohibited
- Technical limits (file type, file size, validation) are binding
7. Limitation of Liability
IMPORTANT: To the extent permitted by law, our liability is limited.
Except where mandatory law requires otherwise, Wapps GmbH and affiliated entities are not liable for:
- QR code issues: Unscannable, misconfigured, or otherwise defective QR codes and related consequences.
- Content liability: User-provided content, destinations, redirects, or statements.
- Business losses: Lost profit, lost revenue, reputational harm, or lost opportunities.
- Data loss: Loss, corruption, delayed processing, or unavailability of data (including tracking/analytics data) unless caused intentionally or by gross negligence.
- Consequential damages: Indirect, incidental, special, or other consequential losses.
- Service interruptions: Downtime, maintenance, capacity constraints, delays, third-party outages, or security-related restrictions, including temporarily unreachable redirect or landing routes.
- Third-party services: Acts or failures of external providers such as hosting, payment, DNS, CDN, email, monitoring, or infrastructure vendors.
- Security incidents: Damages from attacks, misuse, or unauthorized access outside our reasonable control.
Maximum liability cap: To the extent permitted by law, our total liability per damage event is limited to foreseeable, typical contractual damage. For paid use, liability is additionally capped at the fees actually paid by the affected customer in the 12 months preceding the damage-causing event. For free use, we are liable for slight negligence only in case of a breach of essential contractual obligations (cardinal duties), and in that case up to EUR 100 per damage event; otherwise, liability for slight negligence in free use is excluded.
Legal carve-out: Mandatory liability remains unaffected, including liability for intent, gross negligence, personal injury, and mandatory product-liability law.
Important: You are responsible for lawful and correct operation of your QR codes, including final checks before publication or print.
8. Pricing, Billing, Term, and Withdrawal
The following additional terms apply to paid Smart QR services:
- Payment processing: Payments, subscriptions, and invoicing events are handled via Stripe.
- Subscription term and renewal: Subscriptions generally renew automatically for the selected billing interval unless canceled before renewal.
- Cancellation: Cancellations take effect at the end of the current billing period; paid features generally remain available until then.
- Downgrade effects: After a paid plan ends, features, limits, and analytics access may be reduced according to the free plan.
- Fair Use (Smart QR/API): Even on the Business plan, there is no claim to unlimited infrastructure capacity. Included usage is intended for normal business use of Smart QR and API features.
- Usage is considered exceptional in particular when automated processes persistently exceed documented plan or rate limits, or generate an atypically high volume of Smart QR creations, redirects, or API requests in a short period.
- For exceptional usage, we will generally notify you in advance and offer a suitable upgrade, usage-based overage pricing, or custom enterprise terms. Until resolved, we may apply proportionate throttling (for example rate limits or queueing). Temporary restriction or suspension is used only when stability or security is at risk, or when no agreement is reached; immediate protective actions remain permitted in urgent risk scenarios.
- One-time purchases and credits: Unless mandatory law requires otherwise, delivered digital services and consumed credits are non-refundable.
- Consumer withdrawal rights (where applicable): For digital services, withdrawal rights may expire early once performance begins if you expressly consented and acknowledged the loss of the withdrawal right.
Mandatory consumer-protection rights remain unaffected.

Key points:
- Offline QR features can be used locally in the browser
- Smart QR features require an account and involve server-side processing and storage
- Payment workflows are handled via Stripe
- Legal bases, retention periods, and data-subject rights are described in the Privacy Policy
10. Third-Party Services
We rely on external providers for hosting, database/auth/storage, payments, and error monitoring (for example Vercel, Supabase, Stripe, Sentry).
External websites, products, and services are governed by their own terms and privacy notices. We do not fully control them.
Fair-QR may include affiliate links to recommended products and services (clearly marked with an asterisk * or a "Partner" label). If you click these links and make a purchase, we may receive a commission. This does not affect your price. Once you leave Fair-QR, the partner's terms and privacy policy apply.
11. Changes to Terms
We may update these terms when the product evolves, legal requirements change, or service providers change. The published current version applies.

12. Governing Law
These terms are governed by Austrian law, excluding its conflict-of-law rules. Where legally permissible, venue is Steyr, Austria.
13. Severability
If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in effect.
